Terms and conditions of sale

Article 1. Purpose and scope
These General Terms and Conditions of Sale (the “Terms”) govern all sales concluded between:
- K&J cos. SAS, hereinafter “nuaj.” or “the Seller”, a simplified joint-stock company (société par actions simplifiée) registered with the Marseille Trade and Companies Register (RCS) under number 103 971 255, whose registered office is at 85 Traverse de la Granière, 13011 Marseille, France, and which can be contacted at hello@bynuaj.fr;
- Any natural person of legal age and with legal capacity, acting for personal, non-professional purposes, hereinafter “the Customer”.
The Terms are available at all times on the bynuaj.fr website and prevail over any other version. Any order implies the Customer's unreserved acceptance of these Terms.
Article 2. Products
The products offered for sale are LED photobiomodulation devices for cosmetic home use: aura (LED face mask) and contour (LED device for the neck and jawline).
These devices bear the CE marking and comply with the applicable product regulations (CE, KC, RoHS). They are made in South Korea by our manufacturing partner.
Each order includes a free gift, invoiced at €0: a ceramic gua sha, preselected, or a roller, as the Customer chooses. The gift is made in China.
The main characteristics, the price and the delivery conditions are stated on the product page. Photographs are provided for illustration only and are not contractually binding.
Article 3. Prices and payment
Prices are shown in euros including all taxes (20% VAT included), excluding shipping costs. The Seller reserves the right to change its prices at any time; products are invoiced at the prices in force when the order is confirmed.
Payment is made by bank card (Visa, Mastercard, American Express) via Shopify Payments, and by the other methods offered at checkout (Apple Pay, Shop Pay, PayPal). Payment in three interest-free instalments is offered by Klarna, subject to its approval: the credit agreement is then concluded between the Customer and Klarna, and the Seller plays no part in that decision. Payment is due in full at the time of the order.
Article 4. Right of withdrawal
In accordance with articles L221-18 et seq. of the French Consumer Code (Code de la consommation), the Customer has fourteen (14) calendar days from receipt of the product to exercise the right of withdrawal, without having to give reasons or bear any costs other than the direct cost of return. When the order covers several products delivered separately, this period runs from receipt of the last product. The Customer may also exercise this right as soon as the contract is concluded, without waiting for delivery.
To exercise this right, the Customer notifies their decision by means of an unambiguous statement, by email to hello@bynuaj.fr or by post to K&J cos. SAS, 85 Traverse de la Granière, 13011 Marseille, France. The Customer may use the model withdrawal form in the annex to these Terms, but this is not compulsory.
The Customer may also exercise the right of withdrawal online on the Right of withdrawal page (the “Renoncer au contrat ici” function, meaning “withdraw from the contract here”). If the Customer uses this online function, the Seller sends them, without undue delay, an acknowledgement of receipt of the withdrawal on a durable medium (by email), including its content and the date and time of its submission.
The Customer returns the product without undue delay and no later than fourteen (14) days after communicating their decision. The direct cost of return is borne by the Customer, except where the product is defective, non-conforming or sent in error.
The Seller refunds all sums paid, including standard shipping costs, no later than fourteen (14) days after being informed of the decision to withdraw, using the same means of payment as the one used for the order. The refund may be withheld until the product has been received back or until proof of its dispatch has been supplied, whichever is earlier. The Customer may be held liable for any loss in value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning; the amount refunded may then be reduced by that loss in value.
Article 5. Pre-order, cancellation and dispatch date
The devices are currently offered on pre-order. The order is confirmed and paid at checkout, and dispatch is planned from late October 2026, in order of receipt. This date is brought to the Customer's attention before the contract is concluded, in accordance with article L216-1 of the French Consumer Code.
Free cancellation before dispatch. As long as the order has not been dispatched, the Customer may cancel it free of charge and without giving a reason, by email to hello@bynuaj.fr or from the Right of withdrawal page. The Seller then refunds all sums paid, using the same means of payment, no later than fourteen (14) days after the request.
Postponement or delay. If the dispatch date were to be postponed, the Customer would be informed by email and could cancel the order under the conditions of the previous paragraph. If the Seller does not deliver by the announced date, the Customer may, in accordance with article L216-6 of the French Consumer Code, require the Seller, by registered letter with acknowledgement of receipt or in writing on another durable medium (for example an email), to deliver within a reasonable additional period, and then terminate the contract by the same means if delivery does not take place within that period. The Customer may terminate the contract immediately if the Seller refuses to deliver or if it is clear that the Seller will not deliver, or if the delivery date was an essential condition of the contract for the Customer. In accordance with article L216-7 of the French Consumer Code, the Seller then refunds all sums paid no later than fourteen (14) days after the date on which the contract was terminated.
The fourteen (14) day withdrawal period provided for in article 4 runs from receipt of the product, not from the order; the Customer may, however, exercise this right as soon as the order is placed.
Article 6. Delivery
The Seller delivers only to the countries and territories listed below, grouped by tracked shipping rate:
- Mainland France and Corsica: free shipping for orders of €65 or more, which covers all the devices offered (€7.99 below this threshold);
- European Union, Andorra and Monaco, €9.90: Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain (including the Canary Islands, Ceuta and Melilla);
- Rest of Europe, €19.90: Åland Islands, Albania, Armenia, Bosnia and Herzegovina, Faroe Islands, Georgia, Gibraltar, Greenland, Guernsey, Iceland, Isle of Man, Jersey, Kosovo, Liechtenstein, Moldova, Montenegro, North Macedonia, Serbia, Switzerland, Turkey, Ukraine, United Kingdom;
- French overseas territories, €19.90: French Guiana, French Polynesia, Guadeloupe, Martinique, Mayotte, New Caledonia, Réunion, Saint Barthélemy, Saint Martin, Saint Pierre and Miquelon, Wallis and Futuna.
The Seller does not currently deliver to Italy, Norway or Sweden, or to any other country or territory not on this list. Areas subject to international sanctions are excluded. Delivery times are detailed on the Shipping page.
The exact shipping cost is shown before the order is confirmed. Outside the European Union, and in the French overseas territories, the Canary Islands, Ceuta, Melilla and the Åland Islands, import duties and taxes may be payable on delivery, at the Customer's expense.
The delivery times stated run from dispatch of the parcel. Risk passes to the Customer when the parcel is handed over by the carrier.
Article 7. Legal guarantees
The Seller is bound by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) and by the legal guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code), under the conditions set out below (regulatory wording, translated from French).
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.
Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all the updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the guarantee that remained to run until the goods are returned in working order.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund in return for giving back the goods.
To claim under these guarantees, the Customer contacts customer service at hello@bynuaj.fr, stating the order number and the defect observed.
Article 8. nuaj. commercial warranty
Independently of the legal guarantees set out in article 7, which apply in all cases and which this warranty neither replaces nor limits, the aura and contour devices are covered by a commercial warranty granted by K&J cos. SAS, 85 Traverse de la Granière, 13011 Marseille, France:
- Scope: manufacturing defects of the device;
- Duration: two (2) years from delivery of the device;
- Territory: the delivery countries and territories listed in article 6;
- Price: included in the price of the device, at no extra cost;
- How to claim: request sent to hello@bynuaj.fr with the order number and a description of the defect.
In accordance with article L217-22 of the French Consumer Code, the Customer is informed that, independently of this commercial warranty, they benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, under the conditions set out in the box in article 7.
Article 9. Precautions for use
nuaj. devices are LED photobiomodulation devices for cosmetic home use. They are not a substitute for medical advice. It is recommended to consult a doctor before use in the event of:
- Pregnancy or breastfeeding;
- A skin condition or known photosensitivity;
- Photosensitising medication (retinoids, certain antibiotics);
- A pacemaker or other implanted medical device;
- A history of skin cancer.
The Customer undertakes to follow the precautions for use set out in the instructions supplied with the product.
Article 10. Liability
The Seller cannot be held liable for non-performance or improper performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
Article 11. Personal data
The processing of personal data is governed by our privacy policy, in compliance with the GDPR (Regulation (EU) 2016/679).
Article 12. Complaints and consumer mediation
In the event of a dispute, the Customer first sends a written complaint to customer service, by email to hello@bynuaj.fr or by post to K&J cos. SAS, 85 Traverse de la Granière, 13011 Marseille, France.
In accordance with articles L612-1 et seq. of the French Consumer Code, if the dispute could not be settled through this complaint, the consumer Customer may use, free of charge, the consumer mediator to which the Seller is subject:

To be admissible, the mediation request requires in particular that the Customer has first tried to resolve the dispute directly with the Seller through a written complaint, and that the request is submitted to the mediator within one year of that written complaint (article L612-2 of the French Consumer Code).
Article 13. Governing law and jurisdiction
These Terms are governed by French law. This choice does not deprive a consumer Customer residing in another country of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
In the event of a dispute not resolved amicably, the consumer Customer may bring proceedings, at their choice, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they lived at the time the contract was concluded or the harmful event occurred (article R631-3 of the French Consumer Code).
